At Fundicum, we work with a global network of travel and tourism service providers. We are committed to providing the best services to our customers and strive to expand qualitatively and enhance our presence in the global market within the framework of our technical expertise, making us the ideal destination and your ideal choice for reservations. Any of the following phrases is used, it means the following:
1. "Company" means Fundicum, licensed by the Ministry of Tourism in the Kingdom of Saudi Arabia to provide hospitality reservation services.
2. "Platform" is Fundicum's online portal, which allows users to make reservations for hospitality units (including hotels, apartments, and chalets at competitive prices), in addition to other services advertised through official channels.
3. The Application is the Fundicum software available for download on smart devices, whether running iOS or Android, which enables users to book hospitality units, including hotels, apartments, and chalets, at competitive prices, in addition to other services advertised through official channels.
4. The Service Provider is the tourist facility listed on the Fundicum platform, which includes hotels, chalets, furnished apartments, and other licensed temporary accommodation facilities that provide hospitality services to guests.
5. The Customer is the individual or legal entity who uses the Platform or Application to book hospitality units or other services offered and advertised through official channels and has a registered membership account that includes a username and personal password.
Acceptance of Terms and Conditions
By using either or any of the Fundicum Platform or Application, you acknowledge and agree to the following:
1. Full and unconditional acceptance of all of the Fundicum Terms and Conditions and Privacy Policy.
2. Confirmation of being of legal age (18) to use the Platform or Application.
3. Commitment to providing accurate and correct information when making a reservation.
4. Undertaking not to create more than one account with the same username.
5. Maintaining the confidentiality of your account-related information, including but not limited to your username, password, and any other information that a person must keep confidential.
6. Acknowledging full responsibility for all transactions made through your account on the Platform, even if the reservations are made on behalf of a third party.
Please read the Terms and Conditions carefully before using Fundicum's services, as your continued use of the Platform or Application constitutes your express acceptance of these Terms and Conditions.

Fundicum provides its services in accordance with the highest regulatory standards, ensuring its clients are confidently dealing with a certified and officially licensed commercial entity in the tourism sector.

Use Policy and Controls
1. Use is permitted for legitimate personal purposes only. Any commercial use is prohibited without written permission from the company.
· You must be of legal age when using the platform, application, or both.
· The company allows reservations on behalf of a third party, with the reservation maker obligated to inform the reservation holder of the reservation details and information, including the first and last name of the person who will be present at the service provider's facility upon check-in.
· Any action that may cause unintended pressure or impact on the infrastructure is prohibited.
· It is prohibited to take any action that may cause harm, conflict with Fundicum's interests, hinder access to certain content, or impair the availability of content, whether written, graphic, or software.
· Impersonation, distortion of membership information, or attempts to breach information are prohibited.
· It is prohibited to violate any legal right of the company protected by intellectual property rights, or the company’s works, designs, or content, whether written or graphic.
· Use of the platform for illegal purposes or those that violate customs and laws is prohibited.
· It is prohibited to take actions that may affect the infrastructure, change prices or content, or create fake or duplicate reservations in any form.
· Any action that may lead to system breaches or disruption of service is prohibited.
· Users must adhere to all terms and conditions stated on the platform or application when using them.
2. The Company reserves the full right to evaluate any other activities or behaviors and classify them as acceptable or unacceptable use, while retaining the full legal right to implement any of the actions mentioned in Paragraph 3 of this Section.
3. Any violation of these Terms shall be sufficient grounds for account suspension, immediate termination of service, warning, cancellation of service, reservation, or removal of any additional features, while reserving the Company's right to take legal action.
Legal Scope of Limitation of Liability
1. The service provider is always responsible for the accuracy of the content, whether written or visual, while Fundicum reserves all legal and moral rights to take any action it deems appropriate. Fundicum is not liable for any guarantees or compensation for any shortcomings, ambiguity, or errors arising from this information.
2. The company makes every effort to verify the legality of the service provider's activity under a license it must provide to the company. The company also endeavors to verify the accuracy of the information, whether visual or written, provided by the service provider. However, it does not guarantee this, as this is due to the service provider's input.
3. The company has the right to take any legal action (whether by warning, temporary deletion, total deletion, or modification) from the website if it discovers in any way a breach by the service provider of the information it provides, whether written or visual, or if a complaint from its customers is serious, as the company takes its customers' opinions very seriously.
4. Under no circumstances shall the Company or its Service Providers be liable, directly or indirectly, for any damages arising from any means related to the use of the Site or the inability to use it.
5. The Company shall not be bound by any warranties or commitments in the event of errors, whether caused by force majeure, such as total curfews or airport closures. The Company shall not be held responsible for such errors. The Company endeavors to minimize the burden on its customers at its sole discretion, within the limits it deems appropriate, provided that the obligation always falls on the Service Provider or Customer.
6. All information displayed on the Platform and Application is information obtained by the Service Providers. However, the Company strives to provide the most up-to-date and accurate information, but it does not guarantee its accuracy at all times, as it relies on various standards.
7. Fundicum reserves all legal rights to take necessary action against any natural or legal person who commits any offense against the Company, its platform, or its application, whether such offense is moral, technical, literary, artistic, or involves threats, downloading viruses or malicious programs, or any behavior that exceeds the normal limits of use, whether committed directly or indirectly, or directed at any of its customers. This clause constitutes a binding legal obligation, and anyone who violates it is subject to legal accountability in accordance with applicable laws and regulations.
Readiness for Use (Platform - Application)
The Company uses the highest technical standards to ensure the platform and application are as ready as possible to ensure the continuity of all services and the best security measures.
Proprietary Rights
1. All content displayed on the website, whether written or photographic, may not be used by anyone for any purpose unless there is express written consent from Fundicum to use some or all of the content. The Company reserves the right to seek recourse against anyone who violates its legal rights.
2. The Company disclaims any legal liability for any unauthorized use of the platform or application that results in a violation of the intellectual property rights or the private rights of service providers. The Company may, within the limits permitted by law, cooperate with affected service providers to enable them to take appropriate legal action against those who caused the damage.
3. It is prohibited for anyone to copy, modify, transfer, display, republish, produce, or create derivative works from the platform or application.
4. All marks associated with the Company are trademarks protected by law.
Memberships
1. Upon creating a membership, the user agrees to all terms and conditions and the Privacy Policy without restriction or qualification.
2. The customer must enter the first and last name of the main person in the reservation who will be present at the service provider's facility. The customer also pledges the accuracy of this information, and the company assumes no liability for any negligence, defect, or error.
3. In addition to the basic (free) membership, the company offers paid memberships that allow users to enjoy specific benefits and services, as specified in the terms and conditions of each membership. The customer acknowledges that these benefits are subject to the terms approved at the time of subscription, and the company does not bear any responsibility for any unintended technical or operational malfunction that may affect certain services or benefits, within the limits permitted by the system. The company is not obligated to provide any additional features or commitments not expressly stated in the membership terms, and reserves the right to amend the terms and conditions of paid memberships by notifying the user via email, in accordance with company policy.
4. The company’s policy requires that the deletion of memberships and all data associated with them be in accordance with the policy followed when deleting, provided that the request is submitted via the following email: support@fundicum.com, titled “Request to Delete Membership” with the full name of the member, and that the deletion request is sent from the same email registered with the membership.
Booking Terms and Conditions
1. The customer must accurately specify their destination, arrival and departure dates, the number of guests, children, the number of rooms, and their ages, and ensure the accuracy of the information entered.
2. Before completing the reservation, the customer acknowledges their agreement to the Fundicum Terms and Conditions and confirms this by clicking on the confirmation button. We therefore urge our customers to read the terms and conditions thoroughly.
3. Before completing the reservation, the platform and application provide a summary of the most important information. Customers are requested to verify their reservations.
4. Fundicum assumes no responsibility for any error made by the customer in entering the reservation data. Whether or not this error is corrected is subject to the service provider's policy.
5. The customer is obligated to verify the accuracy and correctness of the personal information entered before completing the reservation, including entering the first and last name of the main person responsible for the reservation in English. The customer must also ensure that the main person is of legal age (18). Fundicum assumes no responsibility for any error in entering the first and last name or failure to provide all required information under this clause.
Additional Service
As an initiative to enhance the customer experience, the company offers an additional service to assist customers in resolving issues related to reservation information, subject to the following:
· This service is voluntary and non-binding for the company and does not entail any financial or moral obligation on the part of the company.
· Please note that providing this service does not relieve the customer of their primary responsibility to provide accurate and correct information when making a reservation.
6. Accommodation classification is based on various criteria that vary from country to country and is used as a guide. Therefore, our valued customers should be aware of the accommodation standards in their chosen country. Fundicum does not guarantee or assume any legal responsibility for any classification displayed on the platform or application.
7. Before completing a reservation, the customer acknowledges that they have reviewed all the service provider's facilities and the features of the service provider's units based on the information provided by the service provider. Fundicum shall not bear any responsibility for any shortcomings, errors, unavailability, or unpreparedness on the part of the service provider. If the customer experiences any of the above, we urge you to contact the service provider directly or contact us via the following email: support@fundicum.com.
8. The customer confirms that they have fully reviewed all specifications and information related to the service provider, including, but not limited to: address, classification, terms and conditions of the service provider, cancellation and refund policy, availability, and minimum acceptance.
9. All reservations made through Fundicum are non-refundable and are subject to the service provider's policy. The customer must pay the full amount and have it collected by the company to confirm the reservation.
10. Some service providers may impose a security deposit, fees, or taxes before entering the hotel/chalet apartment. In this case, our valued customers must confirm all these details in advance, disclaiming any responsibility. 11. Some service providers may charge additional fees for extra services, such as extra beds, baby cots, meals, room services, massages, and parking. Fundicum does not include these services or features in the reservation price unless there is a clear and explicit statement indicating they are free. The customer must check with the service provider in advance and request the service beforehand.
12. The company's reservation confirmation policy is subject to availability and final collection.
Terms and Conditions for Prices and Payments
1. All prices displayed on the platform and app are subject to change without prior notice, and their timing cannot be predicted, depending on the service provider's policy.
2. All prices displayed on the platform and app are actual prices, and there are no hidden fees. However, service providers may impose fees, taxes, a guarantee, or a deposit when the customer is present at the service provider's premises. Therefore, Fundicum does not charge any additional amounts for reservations unless there is an explicit and clear statement of such increase. Fundicum's role is limited to what is stated in the reservation.
3. Payments made through the payment gateway are in Saudi Riyals. The currency conversion feature is merely a guide to approximate the price to the customer, as the platform uses Saudi Riyals.
4. The customer must ensure the accuracy, validity, and completeness of all information necessary to complete the payment process. Fundicum does not bear any legal or financial responsibility resulting from the entry of a payment card that does not belong to the user, whether with or without their knowledge. All transactions made on the entered card are legally binding on the customer.
5. Some service providers may impose additional fees for late check-out, depending on their terms and conditions. Therefore, Fundicum assumes no responsibility for any delays caused by the customer.
6. Check-in and check-out times are subject to the service provider's policies. Fundicum assumes no responsibility if the customer arrives or departs before or after the times specified by the service provider. The customer's adherence to these times is entirely their responsibility. Any consequences resulting from early or late arrivals or late or early departures are outside the scope of Fundicum's responsibility.
7. After payment and confirmation of the reservation, the customer will receive a detailed invoice with all the details of their reservation, addressed to the main person in charge of the reservation, who must be present at the service provider's facility.
Cancellation and Refund Policy
1. All reservations on the platform are subject to a clear policy that they are final and non-refundable unless the service provider's policy clearly states otherwise.
2. If the reservation is cancelled and the amount refunded is available in accordance with the terms and conditions, the customer must contact us through the designated complaint channels before the permitted cancellation period. If this period is exceeded, the reservation may still be cancelled, but a portion of the refund may be deducted, or the refund may be in accordance with the partial refund policy.
3. Fundicum reserves the right, at its sole discretion, without justification, to reject its customers' reservations. The reasons for this are many, including, but not limited to, fraud or theft, suspected criminal activity, misleading information, payment card issues, credit card range, incorrect price offered, force majeure, accommodation closure, or inappropriate or unacceptable behavior such as cursing and threats.
In the event of a reservation cancellation where a refund is possible in accordance with the policies followed by either the company or the service provider, the amount will be refunded.
4. Fundicum also reserves the right to block or cancel reservations that may result from pricing errors without prior notice. In this case, the company and service provider's policy is to refund the customer in full.
Terms and Conditions for Offers, Discounts, and Marketing Operations
1. All company offers and discounts are displayed on accounts with the company's official ID as follows: (Platform - Application - TikTok - Snapchat - Instagram - Facebook - WhatsApp - Telegram - YouTube - LinkedIn - Email). Therefore, any offer or discount outside this scope is invalid and is considered a non-binding statement on the platform. We emphasize to our valued customers the necessity of obtaining information from official sources.
2. Upon registering for membership, you unconditionally and explicitly consent to the provision of your personal information to the company, for use in all marketing methods. However, the company emphasizes the protection of your personal data from publication or sale, and that this information is strictly confidential. It is shared information between the customer and Fundicum, including banking information.
3. The customer agrees to provide Fundicum with their information for marketing purposes. The customer also has the right to request the company to delete their data in full, in accordance with the communication channels in the complaints section.
4. All customer data is kept strictly confidential and will not be provided to any entity or party outside the company unless the company is legally obligated to provide this information to a government institution, in accordance with official requests from official bodies within the Kingdom, in accordance with the requirements of the law, and within the permitted legal limits.
Governing Law
By using the platform and application, you agree to all terms and conditions governed by the laws of the Kingdom of Saudi Arabia. This constitutes your consent to submit to the jurisdiction of the Kingdom's judicial authority, with the company reserving the right to take any legal action or prosecution in the country where the persons who accessed the platform or application are located.
Complaints Policy
1. Fundicum receives customer complaints and handles them with the utmost seriousness according to the following channels and methods: support@fundicum.com, our contact form, or via +9660500966046.
2. Customer complaints are handled within 24 hours to nine days of submission and receipt, and the customer is notified of a response to their complaint within this specified period.
Terms and Conditions for Service Providers
These terms and conditions outline the terms and conditions for service providers to add a property to Fundicum and are an integral part of the General Terms and Conditions.
1. Fundicum aims to offer a limited number of quality apartments and chalets in each city within the Kingdom of Saudi Arabia to increase occupancy in service provider units and advance together towards success in the tourism sector.
2. By using this service ("Add Property"), you agree to be bound by the terms and conditions referred to herein, the General Terms and Conditions, and the Privacy Policy.
3. Submit the necessary documents as requested (licenses and records) to register the property. The applicant must be the property owner or authorized to do so.
4. Add accurate details about the property, including but not limited to: number of units and their details, services and features, prices, availability, photos, license number from the Ministry of Tourism in the description, terms and conditions, cancellation policy, and any other amounts paid at check-in and check-out.
5. Update periodically to ensure the most up-to-date information and data.
6. Upon confirmation of the reservation, the service provider must prepare and set up the facility for the customer in a manner that complies with applicable laws.
7. Images and content must reflect reality. The use of non-real or misleading images is prohibited.
8. The service provider must always adhere to the highest standards of transparency and clarity in all information, whether written or visual.
9. Adding prices is the responsibility of the property owner, and the company bears no responsibility for inaccuracies in these entries.
10. Prices added by the service provider are subject to additional fees for display on the website, which covers operational and marketing costs incurred by the company.
11. The service provider is given an account on its own portal to manage reservations. It must accept or reject reservation requests based on availability and handle them professionally.
12. The service provider receives a dedicated portal account with a wallet showing the total amount of reservations. The customer can request a withdrawal at any time, with transfers taking 3 to 7 business days. The service provider must provide bank account or e-payment methods.
13. The service provider must protect customers' personal data and not share it with third parties except as required by law or at the company’s request.
14. The Ministry of Tourism requires customers to provide ratings for the service provider’s facilities and units. The provider is obligated to allow ratings and must not influence or manipulate them.
15. Fundicum does not bear any responsibility for displaying units, customer reservations, or subsequent transactions. The platform's role is infrastructure only. Responsibility lies between customers and providers, unless rare technical errors occur, in which case the company will address the matter promptly.
16. Property owners must not affect the infrastructure of the platform or application or harm the company in any way.
17. The service provider bears full responsibility for providing all services in accordance with local standards and laws.
18. All content added by the provider remains their property. The company has the right to use some content for marketing, assuring professional and appropriate use.
19. Service providers must adhere to intellectual property laws and notify Fundicum if they wish to use anything owned by the company, and obtain written approval.
20. Fundicum has the right to suspend, cancel, or warn any provider who breaches obligations, abuses the system, or acts against the core purpose of the platform/application.
21. The Company has the right to amend these terms at any time without notice, unless the change directly impacts providers, in which case they will be notified by email.
Final Provisions
1. The Company reserves the right to amend the Terms and Conditions and Privacy Policy without notice, unless such amendment directly impacts a customer's acquired right. Notification shall then be made via official channels or email.
2. If any of these terms are invalidated, the remaining terms shall continue to apply to the fullest extent permitted by law, and you will remain bound by everything contained in the agreement.
In the event of any conflict or discrepancy between the Arabic and English versions of these terms and conditions, the Arabic text shall prevail and be deemed the official and legally binding reference for interpretation and enforcement purposes.
